(\u201cmonday.com\u201d or \u201cwe\u201d) and you, either individually, or on behalf of your employer or any other entity which you represent (\u201cyou\u201d or \u201cyour\u201d), govern the use of the monday.com Certified Expert Catalog (the \u201cExpert Catalog\u201d).<\/p>\n

IF YOU DO NOT AGREE TO COMPLY WITH, AND BE BOUND BY, THESE TERMS OR DO NOT HAVE\u00a0 AUTHORITY TO BIND YOUR EMPLOYER OR ANY OTHER ENTITY (AS APPLICABLE), PLEASE DO\u00a0 NOT ACCEPT THESE TERMS OR USE THE EXPERT CATALOG AND EXPERT SERVICES (AS DEFINED BELOW).<\/p>\n

The monday.com\u2019s Expert Catalog<\/strong><\/p>\n

The Expert Catalog allows you to find and engage with monday.com Certified Experts (as defined below) who offer paid assistance to expand your capabilities of the monday.com platform (\u201cExpert Services\u201d).<\/p>\n

\u201cCertified Experts\u201d – Certified Experts are third parties providing professional services. Certified Experts are not monday.com employees and\/or representatives of monday.com.<\/p>\n

Experts; and Expert Services<\/strong><\/p>\n

Experts are independent third parties. It is clarified that whenever you obtain an Expert Service, you are contracting directly with the Certified Expert, under terms and conditions concluded between you and such Certified Expert. monday.com is not party to such terms, and will not be responsible or liable in any way for the Expert Services or for the actions or omissions of such Certified Expert. Your engagement with a Certified Expert is subject to the Certified Expert\u2019s terms, privacy policies and other applicable terms specified by the Certified Expert (\u201c<\/span>Certified Expert Terms<\/b>\u201d). It is your responsibility to review the Certified Expert Terms and you should not engage in Expert Services if you do not agree with the respective Certified Expert Terms.\u00a0<\/span><\/p>\n

Your engagement with Certified Experts and with any and all Expert Services is and remains, at all times, at your own risk and responsibility. It is your responsibility to evaluate Certified Experts before you engage in Expert Services with them, and you agree that monday.com will not have any liability in connection with, reviewing, certifying or enabling any Certified Expert or as a result from the Expert Services that you obtain. If you have a dispute with a Certified Expert, you agree to release monday.com from any and all claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.<\/span><\/p>\n

Pricing and Payment.<\/strong><\/p>\n

Pricing of any Expert Service shall be set and determined at the sole discretion of the Certified Expert as agreed between you and the Certified Expert. Payment for the Expert Services shall be done directly to the Certified Expert via a third party payment processor (\u201c<\/span>Payment Processor<\/b>\u201d), and shall be subject to Payment Processor\u2019s terms and conditions, as amended from time to time or in the means that will be determined between you and the Certified Expert directly. You will not have any claims against monday.com with respect to amounts paid to any Certified Expert. It is clarified that monday.com is not responsible to any portion of the pricing and payment process.<\/span><\/p>\n

Privacy<\/strong><\/p>\n

Please refer to our <\/span>Privacy Policy<\/span><\/a>, which describes our practices and policies related to the collection, use, and storage of your personal data. For the provisioning of the Expert Catalog, monday.com engages with Certified Experts – whose services are presented and offered on the Expert Catalog. In order to allow them to directly engage with you to receive such services,\u00a0 we may share your relevant Personal Data, including your contact details, email address, and image with the respective Certified Experd.\u00a0<\/span><\/p>\n

Warranties <\/strong><\/p>\n

monday.com DISCLAIMS ALL WARRANTIES REGARDING YOUR USE AND ENGAGEMENT WITH THE EXPERT CATALOG AND ANY EXPERT SERVICES OBTAINED THROUGH THE EXPERT CATALOG. THE EXPERT CATALOG IS PROVIDED “AS IS” AND \u201cAS AVAILABLE\u201d, WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED. monday.com EXPRESSLY DISCLAIMS ALL SUCH WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, QUALITY, COMPLETENESS, NON-INFRINGEMENT, RELIABILITY, AVAILABILITY AND PERFORMANCE.<\/span><\/p>\n

Changes to the monday.com Expert Catalog; General.<\/strong><\/p>\n

monday.com may remove, at its sole discretion, Certified Experts listed on the Expert Catalog. Even if you are affected by such actions of monday.com, you agree that you will not have a claim towards monday.com. monday.com may modify these Terms, terminate the Expert Catalog, or any part thereof, at its sole discretion and without liability to you.<\/p>\n
